The Facts:
Attorneys for the NFL have formally asked a federal court to throw out the lawsuit Henry has filed against the league. The motion was electronically filed in a U.S. District court in New York. The motion was expected in the case that Henry hopes saves him from a one-year league suspension.

If it's not thrown out, the earliest the court case could be settled is by the end of this month. ... Henry has a tentative appeal with the NFL on his positive drug test, which occurred in late August, for Nov. 16. That date could change. Henry will be eligible to play for the Broncos until his appeal is decided. If the NFL doesn't overturn his appeal, there is a chance his suspension would start while his court case proceeds. If he won the case while on suspension, he would likely be reinstated. ... Stay tuned.
